With privacy and accessibility laws constantly changing and evolving in the United States, it’s important to stay up to date and ensure you’re in compliance with accessibility and data privacy.

Did you know that under the Americans with Disabilities Act (ADA), any business that provides products or services to the public is legally required to comply with website accessibility standards?

Ethically, it’s just the right thing to do. But your business can also face legal action if it’s not accessible to Americans with disabilities.

A number of websites offer free testing to determine if your website is accessible, including accessiBe. Even PageSpeed Insights now includes an Accessibility score.

In addition to technical compliance, websites are also required to provide a way for users to submit feedback regarding accessibility. Meet this requirement by adding an Accessibility Statement to the footer of your website.

Privacy Policy

Generally speaking, if you have a form on your website, there’s a good chance you’re required to have a privacy policy.

With data privacy laws continually changing, it’s important to stay informed on the latest regulations. Learn more about recent consumer data privacy laws from Bloomberg Law.

Since your privacy policy must be easy to find and access, the footer is the best place to accomplish this.

There is a good chance your website also uses cookies. Check by scanning your site with Termly.

A growing number of states, including Colorado and soon Minnesota (July 21, 2025), are requiring websites to disclose their use of cookies, respect user opt-out requests, and in some cases, obtain consent for specific uses like targeted advertising or sale of personal information.

There are plenty of cookie consent management platforms to take care of this. For my fellow WordPress users, I recommend the WP Legal Pages (Cookie Consent) plugin, because that one also takes care of our next item: Global Privacy Control.

Global Privacy Control

A growing number of states are also requiring certain websites to be compatible with Global Privacy Control (GPC). Colorado joined this list in 2024. Check individual requirements for states where your website is collecting information from residents to see if yours must comply.

If your website must comply with GPC requirements, WordPress users can check this box (for free!) with the WP Legal Pages (Cookie Consent) plugin. Just make sure you enable the “Respect Do Not Track & Global Privacy Control” setting.

If you don’t use WordPress, you’ll have to search for a third party integration that will enable a similar option. Many require a paid subscription.

In addition to the plugin, you’ll also have to add a gpc.json file to the root folder of your website. Do this by creating a “.well-known” folder at the root of your site and then uploading a gpc.json file with the following code and customizing the date:
